Note: Apple "Appstore" is a trademark, not a patent. Patents protect processes. Trademarks protect words and images that represent your product or business.

I'm not a lawyer, but I think that in this case, "sounds like" would count. Maybe they should have called it an "application store" or "application clearinghouse."

Amazon might argue that "appstore" has gone into general usage, such that people don't think of Apple when they hear "appstore". That defense could work.
